Terms of Service

These Terms of Service govern access to the Axomaly website, alpha-access programme, anomaly detection API, dashboard, and related services. Axomaly is currently operated from South Africa and is not yet operated through an incorporated legal entity. These terms will be updated when the operating entity and commercial service are established.

By accessing or using Axomaly, you agree to these terms. If you use Axomaly on behalf of an organisation, you confirm that you have authority to accept these terms for that organisation.

1. Eligibility

You must be at least 18 years old and legally able to enter into these terms. You must provide accurate information when joining the alpha or creating an account.

2. Alpha Access and Pricing

Axomaly is currently offered free of charge during the alpha. No credit card is required to join the alpha.

Alpha features, limits, and availability may change as the service develops. If Axomaly later introduces paid services, pricing and applicable commercial terms will be presented separately. You will not be charged without first agreeing to the relevant paid terms.

3. Accounts and Credentials

You are responsible for protecting your account credentials, API keys, and authentication tokens. You must not share credentials with unauthorised parties or allow another organisation to use your account.

You are responsible for activity performed through credentials issued to you. Notify support@axomaly.com promptly if you believe credentials have been lost, exposed, or misused.

4. Using the API and Service

Axomaly processes timestamped metric values and optional metadata to identify behaviour that may be unusual. You agree to follow the published API documentation and reasonable technical limits communicated through the service.

You must not:

  • Use Axomaly for unlawful, fraudulent, or abusive purposes
  • Attempt to gain unauthorised access to the service or another customer’s data
  • Interfere with, overload, probe, or disrupt the service or its infrastructure
  • Circumvent authentication, rate limits, or security controls
  • Reverse engineer or attempt to extract non-public source code, models, or algorithms except where applicable law expressly permits it
  • Introduce malicious code or use the service to harm another person or system

We may apply or adjust reasonable rate limits and usage restrictions to protect the stability and security of the alpha service.

5. Customer Data and Privacy

You retain ownership of the data your organisation submits to Axomaly. You grant Axomaly the limited permission required to receive, store, process, and return that data solely to provide and improve the service for your organisation.

Customer metric data is isolated by organisation and is not shared between customers. For the immediate future, Axomaly does not use customer metric data, including anonymised or aggregated derivatives, to train or improve global models shared across customers.

You are responsible for ensuring that you have the rights and lawful basis required to submit data to Axomaly. You should not submit personal, confidential, or sensitive information in metric metadata unless it is necessary and lawful to do so.

6. Detection Results

Anomaly detection is probabilistic. Results may include false positives, false negatives, incomplete explanations, or conclusions that are unsuitable for a particular use case.

Axomaly provides analytical information, not a guarantee that an event has occurred or that a particular external cause has been identified. You remain responsible for evaluating results and independently verifying findings before making critical operational, financial, security, or business decisions.

7. Intellectual Property

Axomaly and its licensors retain all rights in the service, website, API, software, models, algorithms, documentation, branding, and related materials. These terms give you a limited, non-exclusive, non-transferable, revocable right to use the service for your organisation’s internal purposes during the alpha.

Except for the limited right above, these terms do not transfer Axomaly intellectual property to you. Axomaly does not claim ownership of customer data submitted to the service.

8. Availability and Changes

The alpha is an evolving, pre-release service. It may contain defects, change without notice, or experience interruptions. No uptime commitment or service level agreement applies unless Axomaly later agrees to one separately in writing.

We may add, remove, suspend, or modify alpha features and API endpoints. Where practical, we will provide reasonable notice of changes that materially affect active integrations.

9. Third-Party Services

Axomaly may rely on or link to third-party services. Your use of a third-party service may be governed by separate terms and privacy practices. Axomaly is not responsible for third-party services that it does not control.

10. Suspension and Termination

You may stop using Axomaly at any time. To request account closure or deletion of personal information, contact support@axomaly.com.

We may suspend or terminate access when reasonably necessary to protect the service or its users, respond to unlawful or abusive activity, address a security risk, comply with law, or respond to a material breach of these terms.

When access ends, your right to use the service ends. Information is retained or deleted according to the Privacy Policy and applicable legal obligations.

11. Disclaimers

To the maximum extent permitted by applicable law, Axomaly is provided on an “as is” and “as available” basis. We do not promise that the alpha will be uninterrupted, error-free, completely secure, or suitable for every purpose.

Nothing in these terms excludes warranties, rights, or remedies that cannot lawfully be excluded.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Axomaly will not be responsible for indirect, incidental, special, consequential, or punitive loss arising from use of or inability to use the alpha service, including loss of profit, revenue, opportunity, or data.

Nothing in these terms limits liability where applicable law does not permit a limitation.

13. Changes to These Terms

We may update these terms as Axomaly develops or as legal and operational requirements change. The revised terms will be published on this page with a new effective date. Material changes may also be communicated through the service or by email where appropriate.

If you do not agree to revised terms, you should stop using the service.

14. General

If a provision of these terms is found unenforceable, the remaining provisions will continue to apply. A failure to enforce a provision is not a waiver of that provision.
