Welcome to Axomaly! We’re excited to have you use our anomaly detection API platform. Before you get started, please take a moment to read through our Terms and Conditions outlined below.

By accessing or using Axomaly’s services, you agree to be bound by these terms. If you do not agree with any part of these terms, please refrain from using our platform.

1. Account Creation and Usage

1.1. You must be at least 18 years old or have reached the age of majority in your jurisdiction to use Axomaly and create an account.

1.2. You are responsible for maintaining the confidentiality of your account credentials, API keys, authentication tokens, and ensuring their proper use. Any activity performed using your API credentials is your responsibility.

1.3. You agree not to use Axomaly for any illegal or unauthorized purposes and to comply with all applicable laws and regulations.

1.4. You must not share your API keys or authentication tokens with unauthorized third parties. You are solely responsible for all API requests made using your credentials.

1.5. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate and current.

2. API Service Usage

2.1. Axomaly provides a cloud-based anomaly detection API platform that processes metrics and data to identify anomalies, outliers, and unusual patterns in real-time.

2.2. You understand that your use of Axomaly may be subject to limitations, such as API rate limits, request quotas, data processing limits, storage constraints, or other usage restrictions based on your subscription plan.

2.3. You agree not to:

  • Interfere with or disrupt the proper functioning of Axomaly’s API or infrastructure
  • Attempt to gain unauthorized access to any part of our platform, servers, or systems
  • Reverse engineer, decompile, or attempt to extract the source code of our API or algorithms
  • Use the API in a manner that exceeds reasonable request volume or constitutes excessive or abusive usage
  • Circumvent any rate limiting, authentication, or security measures

2.4. We reserve the right to modify, suspend, or discontinue any part of Axomaly’s services, features, or API endpoints with reasonable notice where feasible.

2.5. You are responsible for implementing appropriate error handling and retry logic in your integration with our API.

2.6. We may impose or adjust rate limits and usage quotas to ensure fair usage and system stability for all users.

3. Data and Privacy

3.1. We respect your privacy and handle your personal data in accordance with our Privacy Policy.

3.2. By using Axomaly, you grant us the right to collect and process:

  • API usage data, including request logs, response times, and error rates
  • The metrics and data you submit to our API for anomaly detection analysis
  • Technical data necessary for service delivery and security

3.3. We may use aggregated, anonymized, and de-identified data for statistical analysis, machine learning model improvements, and analytical purposes.

3.4. You represent and warrant that you have the necessary rights and permissions to submit data to our API for processing, and that such data does not violate any third-party rights or applicable laws.

3.5. You are solely responsible for ensuring compliance with all applicable data protection and privacy laws when using our services, including obtaining necessary consents for data processing.

4. Intellectual Property

4.1. All content, materials, technology, and intellectual property provided through Axomaly, including but not limited to our API, algorithms, machine learning models, software, documentation, text, graphics, logos, images, and trademarks, are the property of Axomaly or its licensors.

4.2. You may not copy, modify, distribute, sell, or reproduce any part of Axomaly’s proprietary technology, algorithms, or intellectual property without our explicit written consent.

4.3. Subject to these terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use our API solely for your internal business purposes.

4.4. You retain all rights to the data you submit to our API. We claim no ownership over your data.

5. Payment and Subscription

5.1. Axomaly may require payment for certain services, features, or usage tiers. By subscribing to our paid services, you agree to pay the fees associated with your chosen plan.

5.2. Subscription fees are billed in advance on a recurring basis (monthly, annually, or as otherwise specified) and are non-refundable except as required by law or as explicitly stated in our refund policy.

5.3. We reserve the right to modify our subscription fees and pricing structure, but any changes will be communicated to you at least 30 days in advance of taking effect.

5.4. If payment is not received or payment method is declined, we reserve the right to suspend or terminate your access to our services.

5.5. You are responsible for all taxes associated with your use of our services, excluding taxes based on our net income.

5.6. Overage charges may apply if your usage exceeds the limits of your subscription plan, as outlined in your plan documentation.

6. Service Level and Availability

6.1. While we strive to maintain high availability and uptime, we do not guarantee uninterrupted access to our API services.

6.2. We may perform scheduled maintenance with advance notice when possible, which may result in temporary service interruptions.

6.3. Service Level Agreements (SLAs), if applicable, are specified separately in your subscription agreement or plan documentation.

7. Disclaimer of Warranties

7.1. Axomaly is provided “as is” and “as available” without any warranties or guarantees of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

7.2. We do not warrant that Axomaly will be error-free, secure, uninterrupted, or that our anomaly detection results will be accurate, complete, or suitable for your specific use case.

7.3. You acknowledge that anomaly detection is probabilistic in nature and that our service provides analysis and insights, not guarantees. You are responsible for independently verifying any critical findings.

7.4. We do not warrant that our service will meet your specific requirements or that defects will be corrected.

8. Limitation of Liability

8.1. To the maximum extent permitted by applicable law, in no event shall Axomaly, its affiliates, officers, directors, employees, or licensors be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from:

  • Your use or inability to use our platform or API
  • Any errors, inaccuracies, or omissions in our service or anomaly detection results
  • Any unauthorized access to or alteration of your data
  • Any interruption or cessation of our services
  • Any bugs, viruses, or other harmful components
  • Any loss of profits, revenue, data, or business opportunities

8.2. Our total liability to you for all claims arising from or related to our services shall not exceed the amount you paid to Axomaly in the 12 months preceding the claim.

8.3. Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.

9. Indemnification

9.1. You agree to indemnify, defend, and hold harmless Axomaly and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees) arising from:

  • Your use or misuse of our services
  • Your violation of these Terms and Conditions
  • Your violation of any third-party rights
  • Your violation of applicable laws or regulations
  • Any data you submit to our API

10. Termination

10.1. You may terminate your account at any time by following the account closure process in your dashboard or by contacting our support team.

10.2. Axomaly reserves the right to suspend or terminate your account immediately and without prior notice for:

  • Any violation of these Terms and Conditions
  • Fraudulent, abusive, or illegal activity
  • Non-payment of fees
  • Extended periods of inactivity
  • Breach of security or misuse of API credentials

10.3. Upon termination, your right to access and use our services will immediately cease, and we may delete your account data in accordance with our data retention policies.

10.4. Sections that by their nature should survive termination (including intellectual property, limitation of liability, indemnification, and governing law) shall continue to apply after termination.

11. API Terms and Restrictions

11.1. You must comply with our API documentation and usage guidelines.

11.2. You must not use our API to:

  • Create a competing product or service
  • Build a product using similar ideas, features, functions, or graphics
  • Attempt to cloak or conceal your identity when requesting authorization to use our API
  • Store or cache API responses beyond reasonable limits for functionality

11.3. We reserve the right to revoke API access at any time for violation of these terms.

12. Changes to Terms

12.1. We may update these Terms and Conditions from time to time to reflect changes in our services, business practices, or legal requirements.

12.2. We will notify you of material changes by email or through our platform at least 30 days before the effective date.

12.3. Your continued use of Axomaly after changes take effect constitutes acceptance of the updated terms.

13. Governing Law and Dispute Resolution

13.1. These Terms and Conditions shall be governed by and construed in accordance with the laws of the jurisdiction in which Axomaly is registered, without regard to its conflict of laws principles.

13.2. Any disputes arising from these terms or your use of our services shall be resolved through binding arbitration or in the courts of the jurisdiction specified in our registration, as applicable.

13.3. You agree to resolve disputes on an individual basis and waive any right to participate in class action lawsuits or class-wide arbitration.

14. Miscellaneous

14.1. These Terms and Conditions constitute the entire agreement between you and Axomaly regarding your use of our services.

14.2. If any provision of these terms is found to be unenforceable or invalid, the remaining provisions shall continue in full force and effect.

14.3. Our failure to enforce any right or provision shall not constitute a waiver of such right or provision.

14.4. You may not assign or transfer your rights or obligations under these terms without our prior written consent.

14.5. Section headings are for convenience only and do not affect interpretation of these terms.
